消費者保護를 위한 法政策

Abstract

오늘날 소비자문제는 환경문제와 더불어 세계 2대 과제의 하나로 되어 있다. 소비자문제를 해결하기 위해 우리나라에서도 1980년 소비자보호법을 제정하였고, 1986년에는 동법을 개정, 소비자의 7대권리를 선언하였다. 그러나 소비자문제는 이러한 기본법의 제정만으로 해결되는 것은 아니며, 이러한 기본법의 정신에 따라 구체적 입법이 행하여 짐으로써 달성된다. 이에 본고에서는 소비자의 안전을 보장하고 상품의 결함으로 인한 피해를 합리적으로 구제하기 위해 제조물책임법의 제정, 선택할 권리를 보장하기 위한 독점규제법의 활성화와 이를 위한 현행 독점규제법의 일부조항의 개정, 부당약관규제 방법의 재검토 및 소비자피해의 특수성을 감안하여 집단소송과 단체소송제도의 도입이 필요함을 역설하였다.

Nowadays the consumer problem and the environmental ploblem are two main controversial issues in the world. To protect consumer we enacted the consumer protection act in 1980 and revised it in 1986. The revision act pronounce seven main consumer rights. But only to pronounce consumer rights couldn't solve the consumer ploblem automatically. To regain consumer soverignty we need to establish many acts which realize the consumer rights.

This paper propose

ⅰ) to enact the product liability act to realize the right to be safety and the right to recourse and redress,

ⅱ) to make the anti-trust law more practical effect and to that purpose to revise some provisions of the MONOPOLY REGULATION and FAIR TRADE ACT

ⅲ) to reconsider the UNFAIR CONTRACT TERMS REGULATION ACT

ⅳ) to approve the class action and 'Verbandsklage'
