Abstract
不當勞動行爲制度의 存在價値는 資本所有權의 諸機能을 侵害하여 勤勞者의 利益에 逆機能을 侵害하는 使用者의 作用에서 蒸起되는 바 勤勞者의 基本權(團結權, 團體交涉, 團體行動權 生存權)이 侵害되었을 때 原狀 回復보다 使用者의 社會的責任이 더욱 切感되고 勞動委員會의 本 質的이고 積極的인 信賴를 構築하는 方案이 硏究檢討되어야 한다.
Since the 29 June dencocratigation announcement. the unfair Labor Practice and its remedy in Korea have been much focused on and become an essentical and Business Circle .

When the basic right are infringed. it is Generally regarded the best way here in Korea if right of unity. right of Collective bargaining. and right of collective action can be restored to the original state, but it is deeply required that the social . responsibilites should be turther extended to employers therfore. in this respect. we shoed try to find out the true meaning of the untair labor practice system.
