- Abstract
- 일반적으로 자녀의 복리(welfare of child)나 子女의 최선의 이익(the best interest of child)은 현대 친권법의 기본 이념이라고 이해되고 있다. 각국의 입법 및 실무도 이러한 자녀복리원칙에 입각하여 자녀가 관련된 사안 특히 친권의 제한 및 상실, 이혼시 친권자 ㆍ 양육자 결정 등의 영역에서 자녀의 복리를 강조하고 있다.
그러나 자녀복리라는 개념은 상당히 이념적이고 복합적이며 상대적인 것이어서 종종 자의적인 것이라는 평가를 받기도 한다.
본고에서는 자녀복리원칙이 어떤 과정을 거쳐 현대 친권법의 지도 이념이 되었는지를 먼저 살펴 본 후에, 복리개념의 추상성이나 상대성에 대한 비판에도 불구하고 자녀복리원칙이 오늘날 여전히 그 지위를 유지할 필요성에 대하여 알아보았다.
Welfare principle means that when any court determines any question with respect to the upbringing of the child or the administration of the child's property or the application of any income arising from it or the termination of parental right, the child's welfare shall be the court's paramount consideration. But the concept of welfare of child is indeterminate. And beliefs about a child's best interest or welfare have changed and will change according to current views on the matters such as child-rearing and parenting. This paper asserts that the 'welfare of the child' principle must be the leading ideology of modern parental right in spite of its indetermination.
