- Abstract
- 본 논문은, 근로유인형 장애인 복지정책의 구현을 위한 바람직한 장애인 고용촉진정책의 방향과 과제를 제시하고자, 미국 장애인에 관한 법률(The Americans With Disabilities Act:ADA)에 명시된 공식화된 요건 중에서 특히 고용관리상 사업주 책임과 관련한 "적정한 조정(reasonable accommodation)"과 "과도한 부담(undue hardship)"의 개념과 논리를 중심으로 사업주의 적정한 고용관리를 행할 의무로서의 사업주 책임의 문제를 소개함으로써 고용촉진을 위한 보다 적극적 개입과 유인책 관점에서의 조직관리의 필요성을 강조한다.
From the viewpoint of government welfare (workfare) policy toward handicapped individuals, disability is just a human variation, and people with disability are expected to have job opportunities to work. This study introduces the 'Reasonable Accommodation' concerns in the Americans With Disabilities Act(ADA) of 1990 and discusses the policy implications of the basic tenets for promoting employment opportunities of persons with disabilities in Korean labor marker.
