Abstract

제도적 측면에서 볼 때, 쓰레기매립장의 건설과 관련한 갈등은 단순히 지방자치제의 실시로 야기된 것이 아니라 지방자치제도의 실시와 환경관련법의 정비와 보조를 맞출 수 있는 쓰레기매립장 건설관련법이 정비되지 못한채 중복된 신호를 보냄으로서 유발되었다고 하겠다. 지속적인 갈등은 신호중복현상을 고칠 수 있는 제도의 변경을 요청하였고, 변경된 제도는 주민의 참여와 보상방안의 틀을 제공하게 되었으며, 이에 따라 적절?? 역할/비용분담의 방안을 찾는 과정이 나타나게 되었다. 이는 지방자치제도가 상호설득과정을 통해 갈등관리에 기여하고 있음을 나타낸다 하겠다.
