대법원 판례를 통해 본 의료소송 내용분석

Abstract

이 논문은 1953년에서 1998년 5월까지 법원공보 및 판례공보에 수록된 대법원 판례들중 의료소송에 관한 판례 78건을 내용분석 함으로써 우리 나라의 의료소송 실태를 파악하고자 한다. 연도별 의료소송 판?跏炷?, 진료과목별 의료소송 실태 분석, 진료유형별 의료소송 실태 분석, 의료소송 유형별 실태, 의료소송의 결과 등을 구체적으로 분석함으로써 의료소송에 관한 소비자보호제도에 필요한 기초자료를 제공하고자 하였다. 1990년대에 의료소송사건이 크게 증가하였으며, 진료과목별로 분석을 하면 산부인과 사고가 가장 많았고, 진료유형별로 보면 수술에 관한 사고가 가장 많았다. 1990년대에 들어서면서 의료소비자가 승소하는 경우가 증가하기는 하였으나, 여전히 의료소비자는 의료인의 과실 및 그 과실과 손해발생 사이에 인과관계를 입증하고 증거를 제시하는 과정에서 불리한 상황이다.

This paper analyzed the medical cases of the Supreme Court from 1953 to May in 1998. The purpose of this paper was to provide the basic data to enact the consumer protection system in medical malpractice claims. For this purpose the content of 78 cases were analysed in detail. The number of cases were increased in 1990. The number of medical cases were most in gynecology among clinic types and in surgical operations among treatment type. In 1990 The number of cases that the medical consumer won a suit were increased. But the medical consumers are still in disadvantageous position to prove the causal relation between the medical malpractice and the damage.
