우루과이라운드와 知的所有權

Abstract

知的所有權이라 함은 文學ㆍ藝術 및 科學的 著作物, 實演家의 實演, 音盤 및 放送, 인간노력에 의한 모든 분야에서의 發明, 科學的 發見, 意匠, 商標, 서비스標, 商號 및 기타의 名稱, 不正競爭으로 부터의 保護 等에 관련된 權利와 그밖에 産業, 科學, 文學 또는 藝術分野의 知的活動에서 발생하는 모든 權利를 포함하는 개념이다.

본 연구는 그러한 知的所有權이 왜 자유무역질서를 다루는 가트에서 논의하게 되었는지, 그리고 가트 協商의 타결후에 세워질 새로운 秩序下에서 우리는 어떻게 대응할 것인지에 관한 연구이다.

本 硏究는 서언(제1절), 知的所有權의 內容(제2절), 知的所有權保護의 必要性(제3절), 國際的 保護의 必要性과 知的所有權의 國際的 保護를 위한 종래의 룰(제4절), 가트에서 知的所有權 問題가 논의되게 된 배경(제5절), 가트내에서의 각국의 주장과 예상되는 최종타결내용(제6절), 우루과이라운드의 지적소유권 협상(Negotiating Group on Trade-Related Aspects of Intellectual Property Rights : 이하 TRIPs라고 한다)의 妥結豫想 內容과 우리 현행법을 비교하여 법제도의 정비가 필요한 부분(제7절), 結論(제8절)으로 구성되어 있다.

TRIPs 협상이 타결되면 저작권분야에서 데이타베이스보호나 貸與權 認定 問題, 상표분야에서 色彩商標 問題, 地理的表示分野에서 酒類에 관한 특별보호 問題, 意匠分野에서 織物意匠 問題, 特許分野에서 有性繁植織物 保護나 保護期間의 調整 問題, 非公開情報 分野에서는 정부 제출임상자료에 대한 制度適 整備가 필요하리라고 본다.

그러나 1986년 이후 우리나라는 지속적으로 知的所有權保護를 강화하여 왔고, 현재 그 보호수준에 있어서는 기본적으로 거의 선진국에 육박하고 있으므로 TRIPs협상이 타결되더라도 知的所有權 分野에 대한 규범적 충격은 그리 크지 않을 것이다. 다만 TRIPs의 타결로 인한 사회ㆍ경제적 충격은 상당하리라?? 보여지나 그사이의 적응력 훈련을 통하여 상당한 준비가 갖추어져 있는 것도 사실이다.

현재 UR협상은 완전히 타결을 보지 못하고 있지만 UR이 타결되든 공중분해되든 이와 무관하게 知的所有權의 保護强化 傾向은 앞으로도 지속될 것으로 보인다. 社會가 産業社會에서 知價社會로, 物質優位에서 情報優位로 변화하게 되면 이에 따라 필연적으로 지적 창작물을 보호하는 制度는 강화될 수 밖에 없는 것이다. TRIPs협상은 이러한 경향의 한 단면에 불과하다.

아직 선진국 문턱을 넘지 못한 우리로서는 知的所有權保護의 强化傾向에 대해서는 방어적ㆍ수동적이 되지 않을 수 없을 것이나 오늘날 사회의 변화에 비추어 볼 때 이러한 수동적 태도만으로 일관할 수는 없는 것이다. 사회가 産業社會에서 知價社會로 변화하면 종래보다 많은 종류의 정보에 대해서 보호를 꾀하지 않을 수 없고, 그 보호수준도 강화되지 않을 수 없다. 사태가 그러하다면 보다 능동적이고 적극적인 자세로 知的所有權의 보호환경을 정비하는 것이 보다 바람직하다.

This paper is a study on TRIPs ; Trade-Related Aspects of Intellectual Property Rights. "Intellectual property"(hereinafter "IP") shall include the rights relating to : literary, artistic and scientific works, performances of performing artists, phonograms and broadcasts, inventions in all fields of human endeavor, scientific discoveries, industrial designs, trademarks, service marks and commercial names and designations, protection against unfair competition, and all other rights resulting from intellectual activity in the industrial, scientific, literary or artistic fields.

The main arguments of this paper are :

① why does GATT deal with such a IP(The reasons of Addressing IP Issues in the GATT Negotiations)

② If new rule for the international protection of IP is established, how should we behave under such a new rule.

This paper arrives at the conclusion that :

we live in the information society. To regard IP highly is natural trend in the information society. To establish new rule in GATT is maybe one aspect of this trend.

So this paper propose we should take active and positive attitude on establishing new rule for protecting IP.
