전자상거래 관련 국제규범에 관한 논의

Abstract

국제기구에서의 전자상거래 논의는 범세계적인 전자상?킹? 확대를 위한 장애요인의 제거와 전자상거래에 적합한 국제적인 규범 제정 논의이다. 따라서 정부의 역할은 전자상거래에 필요한 최소한의 환경조성에 국한하고 창의적인 민간부문의 주도적인 역할을 강조하는 것이 기본원칙이다. 그러나 상품과 서비스의 국경간 이동에 따르는 통관, 조세, 거래 이행에서의 분규 및 소비자 보호 등 다양한 문제의 발생이 예상된다. 그러므로 이들 문제의 사전 예방 및 사후 처리를 위한 국제적 규범화 작업이 OECD 및 WTO 등 국제기구에서 미국의 주도로 진행되고 있다. 그리고 전자상거래의 발전을 위하여는 전자상거래에 참여하는 민간부문의 자율규제가 바람직하며, 전자상거래가 기존의 거래와 차별을 받지 않고 또한 법적 안전성과 예측가능성을 보장하는 차원에서 법.제도에 의한 정부의 개입이 제한적으로 요구되는 것이 바람직하다.

Now, electronic commerce is discussed for dismantling the barriers to global electronic commerce and for establishing the global framework by world organization. Therefore, principles for electronic commerce are minimizing the government polices and emphasizing the creative private roles. But various issues are expected for the electronic commerce, for examples, tariffs, taxation, consumer protection, private protection, intellectual property, and security. So, self-regulatory of private sector is desired for the development of eiectronic commerce. The limited government intervention is only required for securing the distinction of transaction.
